how often do you have a union meeting in concord?
we havent had one in gardner for close to 7 months.
is it possible you guys at concord could tell us a few things so we could have a solid local?
the impression everyone at gardner has is that it must be a perfect relationship between the management and the union.
meetings are suppose to be forums to discuss issues and ideas for the future.obviously we at gardner have reached perfect harmony with our environment. maybe we could give you guys a few tips?

Once again there are numerous rumors floating around the D.O.C. I will try my best and give you some accurate info as I have received it. The 5 and out is all but dead at this time the reason given is that we are not now facing layoffs and that would be the only time it would be an option. The budget was signed on 7-25-02 and I have an agreement signed in 1995 by Mr. Bolger and Danny O'neil that states that the clothing allowance (750.00) will be paid in 90 days from the time the budget is signed into law. That makes payment due sometime in October I have not heard anything that it would be delayed. There is a new executive secretary on the e-board his name is Hank Harris and he is out of the maintenance dept in Shirley. Good luck and welcome aboard. There is a labor management meeting tomorrow Thursday 9-5-02 between the e-board and the Mr. Maloney regarding comp time for holiday pay. The commissioner wants to begin implementing this on the next holiday that being Columbus Day and every other holiday there after for fiscal year 03. The union strongly opposes this action and has already started litigation against this from happening, I will keep you posted as the information becomes available. keep in mind that we may be handcuffed by our own contract once again as the language in our contract allows this action to occur, after a discussion with c.o. Hamel I contacted the e-board to clarify if this does go into effect would you have to put in for time off and then be denied in order to get paid in 60 days. The contract may suggest just that but again there is no memorandum of understanding in our contract to clarify this and it is another matter to be negotiated. MCI Concord this year was budgeted for 3,660 hours of o.t. This is a decrease of 3,000 hours from last year to date we have used 868.53 hours leaving a balance of 2,791.47. Needless to say that o.t. will be scarce so take it when you can get it. As always feel free to contact me for any reason.

WORCESTER (AP) -- A Worcester Superior Court jury has awarded $175,000 to a former Concord State Prison inmate in a negligence lawsuit against the state Department of Correction.
The jury found for Albert Gendron's claim that the Department of Correction negligently hired and supervised a correction officer who assaulted him, and that he was then denied adequate medical treatment.
According to the lawsuit, Gendron, of Worcester, was being held at Concord State Prison for a parole violation on Nov. 4, 1992, when he was assaulted by Correction Officer Julio Semidei of Worcester.
In his lawsuit, Gendron said Semidei challenged him to a fight, ordered him from his cell, handcuffed his hands behind his back and then struck him in the genitals from the rear.
Semidei, who died in 1997, then grabbed Gendron by his hair and trousers and rammed his head into a wall, causing a 2-inch cut over his right eye, the lawsuit alleged.
Gendron was transferred to Shirley State Prison and placed in solitary confinement after receiving seven stitches to close the cut.
According to the lawsuit, Gendron said he was denied necessary medical treatment while in solitary confinement. He said he "was forced to remove the seven sutures above his right eye with a plastic fork prong" and received medical attention only after the eye became visibly infected and swollen shut.
In January 1993, the Appointing Authority of the Massachusetts Department of Correction found that Semidei used excessive force against Gendron and falsified both an incident report and a disciplinary report about the incident, according to the lawsuit.
The Civil Service Commission's Division of Administrative Law Appeals later affirmed the decision and Officer Semidei was suspended for 10 days, according to court documents.
The Department of Correction denied any negligence and maintained it was not liable for Gendron's injuries.
A Department of Correction attorney did not return a call Friday seeking comment, the Telegram & Gazette of Worcester reported.

word is the commish wants to give us comp time for our holidays. if its true and happens theres nothing to worry about because the contract says the employer has the option of paying us or giving us comp time.in the same paragraph of the contract it also says if you dont use it within 60 days they have to pay you for it. the worst case scenario is a deferment of pay. its obvious a smoke and mirror budget thing. i dont see kenneway allowing modification of language without negotiations. this is a time when we must have faith in kenneway,he is here for us and hopefully will instill some values in the other e board members. by the way has anyone got info of the full disclosure of the money missing? back in january it was promised to us that when an audit was complete the facts would be disclosed. if these facts are with held be advised the district attorneys office would be more than willing to help us.theres one the da's office doesnt like is someone screwing with others peoples money especially under false pretenses.

As a result of the labor management meeting with Mr. Marshall and the concord management team to include Mr. Grant the following was agreed upon: The s.e.c.c. officers currently holding concord job pick positions will be made sta retaining their shifts and days off as per the trasfer agreement and those jobs will go up for pick for all officers including the s.e.c.c. officers to bid on. There will also be 3 s.t.a./construction jobs posted with the hours of 6:30 a.m. to 2:30 p.m. with the days off being f/s s/s and s/m. at the end of construction these jobs will revert back to s.t.a. 7-3 with the same days off. These adjustments are being made to allevatiate some of the problems with the closing of the gym and hopefully balancing the rosters. These results were achieved as a direct result of both labor and management working together to resolve problems that effect both sides. We truly feel this is an attempt to change the way we do business. It benefits both sides to resolve issues in this fashion. Kenny Ferullo, chief steward

All the eboard members are pointing fingers at Kenneway and the the union members as the cause of our current problems:
1) Keep in mind that long before Kenneway returned from overseas no other eboard member was seen at our facilities, no bills were filed, money was being stolen, and this eboard knew or should have known jobs were threatened and did nothing.
Make no mistake about it. Kenneway is doing a shitty job. He hasn't done a damn thing any different since his return. He has certainly jumped on the bandwagon but he is not the only eboard member at fault. Collectively they have proven they are only out for themselves.
2) While all this has taken place the ebaord claims they sent out a bus to three locations on one particular day that very few seem to remember. Was this the bus that Perron sent out for us to show his support for Slattery in Worchester? Was that the bus they are taking about? The one that was to help Perron's political future? Even if they had sent a bus out ONCE is that the best they can do to rally support?
As pathetic as it may sound I guess the leadership of MCOFU need to have leadership explained to them. You see it works like this. If you have a problem it's your responsibility to solve it. That includes overcoming the apathy of those you lead. If you can't motivate them then your not fit for the job. Sending out a bus once that no one alledgedly responded to would indicate a problem that you need to overcome. Ever time you blame the membership you point a finger at your own inadequacies to lead.
Fix the problem. Start with yourselves.

The DOC lied to the media when it claimed closing SECC, Lancaster and Shirley Min would only increase medium populations to 131% above design capacity. Concord was designed to hold 614 and is currently holding over 1,000 which is over 170 %; Shirley Medium was designed to hold 720 and is currently holding over 1,100 which is at about 150%; NCCI was designed to hold 568 and is currently holding about 1,000 which is about 180%; MCI Norfolk was designed to hold 1,084 and is currently holding over 1,400 which is over 131% design capacity.
Every day there are assualts on correction officers, whether it be by fist, foot, shank, spit, feces, urine, yet we never read about it in the press. Every time a police officer is injured on duty, whether it be by slip and fall, auto accident, assault, shooting, or otherwise, it makes front page news and usually makes the six o'clock news.
Laying off correction officers will definitely impact the amount of safety we will be able to provide the public (our primary goal) when prison populations expand, and prison space shrinks.
Our e-board should go public on every single incident that occurs behind the walls that causes an injury to our brothers and sisters. And, every time the DOC lies to the media, our union e-board should take equal time to tell the facts and set down the truth, whether it be by editorial, interview, or paid advertisement. The general public should know more of what it is that we deal with on a daily basis. And we, our union e-board, should be putting those messages in the public's eye constantly. Don't forget whom the general public is comprised, i.e., politicians, advocates for workplace safety, our families, friends, neighbors, and every political constituency you can imagine. If these people are kept in the dark as to the dangerous nature of our jobs, and are not told the truth against DOC lies, then we might as well stop complaining about everything. Remember, ignorance breeds apathy.

Keep in mind that no matter how many concessions you make, the DOC is going to cut whatever they want to cut. They will tell you that less people will be layed off if you agree to comp time and furloughs and such, but it's been my experience with management (both DOC and in the private sector) that they want labor to give now and give later also. No one is promising anyone that you will get fewer job cuts if you agree to these concessions. Just something to keep in mind. Its like a used car salesmen....they will puff up the number they want in order to cut you back to what they feel like either way. I say give them nothing now and give them nothing later. Make them fight for everything like they make us.

I have no idea what Jack Farrell was talking about on Friday. The information that was given out at the union meeting on Wednesday is still pretty accurate. The D.O.C. is still short 9.9 million dollars. The commissioner is formulating a plan to cut some funds other than layoffs. The union stands firm that we will not get into our contract or give anything up. The smoke is starting to settle and management realizes that there are other people other than just co's that will take a hit. If Jack knows something we don't he hasn't shared it with anyone else. Remain cautiously optomistic on the layoffs, Oct. 1, is still the target date. I will make every effort to keep you informed on the latest information as it happens.

We all know the DOC denies all IA's unless half the shift witnesses the injury and even then they still deny most of them. Well rumor has it that they are now going to not only deny them but they charge you as being AWOL after the super denys the injured officer's request for sick time. It can take months for a judge to rule on IA's so it looks as though this is nothing more than a way to get rid of officers. Alledgedly more than a few officers have been charged with being AWOL in exactly this way already. Neat trick huh? You either drag your injured ass back to work or get fired for being AWOL before an impartial judge can rule on your case. Anyone heard anything about this? The union knows all about it also and refuses to address it. It's inspiring how much our welfare and safety means to both management and our own?

For those of you who aren't aware of it, layoffs are being considered based on time at your facility, not time in the DOC. If that happens a guy with 20 years in could be layed off if he transferred to a new facility just a few years ago. Here are two opinions.
Opinion's supporting institutional seniority:
"While layoffs in the DOC will be new, the state over the years has done away with many other positions in Dept spread out like the DOC. I'll use just one Dept to show what was done. The DMR has closed many of the state schools (spread out and broken up like different DOC institutions) effected employees bumped downward statewide, with the least senior employees being let go."
"If everything went by statewide seniority a CO at Norfolk could bid a job at Walpole"
Opposing opinion:
"Departmental is the key word. Did you forget the DOC is the Department of Corrections??? The department as a whole is being affected. Ask any Probation Officer how they did thier layoffs in the spring. They did not do it by courthouse seniority but by overall seniority (statewide). "
State-wide bumping might rectify the situation to some extent. All I know is that at the end of the day if an officer with 15 years in is layed off and an officer with 3 is allowed to work just because the officer with 15 transferred a year ago thats total bullshit.
What a mess this is going to be. Any other opinions would be appreciated.

Rumors abound that the DOC will be laying-off by institutional seniority, and not by total DOC seniority. Here is what the law states:
"Chapter 31: Section 39. If permanent employees in positions having the same title in a departmental unit are to be separated from such positions because of lack of work or lack of money or abolition of positions, they shall, ... be separated from employment according to their seniority in such unit and shall be reinstated in the same unit and in the same positions or positions similar to those formerly held by them according to such seniority, so that employees senior in length of service, ... shall be retained the longest and reinstated first."
A "departmental unit" is defined in Chapter 31, Section 1 as: "a board, commission, department, or any division, institutional component, or other component of a department established by law, ordinance, or by-law." For example, the Commissioner of the DOC is the appointing authority for all C.O.'s I, II and III, but the DOC is divided into institutional units under Chapter 124, and employees can be laid off within one institutional unit without regard to the seniority of other employees of the same job title in other units.
Bumping Rights: Under Civil Service law, "bumping" refers to the least senior person displacing someone of a lower rank: for example, a newly appointed sergeant with only 4 years in the DOC can accept a demotion and bump a c.o. with less DOC seniority. An employee can bump someone only within his departmental unit.
The way it looks now, if 300 in blue are to be laid off, every institution will take a hit - some will take bigger hits than others. And, if Maloney decides he doesn't want to lay off anyone from Souza or Walpole, then some with 4, 5 or maybe even 6 years in at some other facilities will get the axe. Time will tell.
P.S. The only provision in our contract dealing with layoffs is Article 18. As you can see by reading Section 1 of Article 18, the layoff and recall procedure deals with "non-civil service employess."

The Executive board was still meeting with Commissioner Maloney over the issue of layoffs as of yesterday (8/1/02). No bottom line numbers have been given, as there are still areas of disagreement. As information is provided it will be released.

The Eboard is now talking about informational pickets within days of the state budget being ratified. You gotta be shitting me if you can't figure out that they were told to wait. These guys give new meaning to the word scumbag. And they aren't even sneaky about it. An informational picket months ago would have been useful in rallying public support to maintain the DOC budget so that staffing levels could have been maintained and further overcrowding through prison closings wouldn't take place. What the hell good are pickets now? Whats the point? The budget has already been slashed.

I wish I had good news for everyone, unfortunately, that's not the case.
Today, Tuesday July 30, 2002, it was reported to the Executive assembly that the 5 and out is all but dead. It seems the Executive board was advised some time ago to allow management to file the bill, as it would give the bill a much better chance. Commissioner Maloney sat on the bill that he promised to file until this past June. The Commissioner wanted 1 for 1 hire back language in the bill he was to introduce. When he was told that wouldn't fly, he pretty much said the hell with it. Steve Kenneway contacted Commissioner Maloney and talked some sense into him explaining that if we were going to loose any staff, why not allow people to go who wanted to go, and keep those who wanted to stay. The Commissioner gave the bill to Acting Governor Swift and it sat on her desk, because she said she would not push the bill unless she was assured it would pass. Reluctantly the bill was introduced late. When the Commissioner was told he would not get a 1 for 1 he was no longer seen around the state house. It was also stated that Representative Brian Dempsey and Senator Jajuga were very supportive of our cause and did all they could for us. Mr. Finneran's office was contacted and given information to support the five and out, but he too has not contacted the MCOFU. The bottom line is this, due to poor leadership from Acting Governor Swift and Commissioner Maloney; many DOC staff is likely to be laid off in the very near future.
Commissioner Maloney to date as been asked approximately six (6) times for a layoff plan, and as of this date has not produced one. It has been estimated that approximately 350 pink slips can be expected anytime after today, with as many as 80% of those (280) going to security staff.
A long discussion took place with regard to Paul Boudreau. Steve Kenneway explained the judicial process and the constitution and by-laws.
Many motions were made today asking that the Union become aggressively pro-active. The motions passed unanimously. All staff are being asked to prepare for future pickets and other Union supported activities.

I take no pleasure in repoting this information. The 5 and out is dead at this time. I know a few of the particulars but will get a more definite picture of what is really going on at the general assembly tomorrow 7-30. The layoff numbers being kicked around are yet to be contested, and no layoff plan has been given to the e-bard. I must inform you that layoffs are definite and bumping rights (reassignment of non laid off offices to cover security needs in the most effected institutions) are a reality. I don't want to put out the numbers I got until I can make sure they're accurate as not to put any extra stress on guys on the cusp by seniority. I will be putting out all the inormation released at the assembly on the computer tomorrow evening and would strongly urge every officer to make an attempt to be at the union meeting on 7-31. I will be handing out seniority lists at the union meeting, these lists list your start date only and are not in any chronological order as time in grade as a co2 or co3. You may even be listed before someone who picks ahead of you if you have the same start date. Massachusetts Department of Correction Recieves Federal Grant
Washington, DC- Attorney General John Ashcroft announced on July 15, 2002, that Massachusetts Department of Correction will receive $1,000,077 to assess and assist in meeting the needs of high-risk offenders ages 18-35 in housing, substance abuse, mental health and employment.
Commissioner Michael T. Maloney is pleased with the decision of the Department of Justice to grant this award to the Massachusetts Department of Correction.
“ This grant will help us expand the partnerships with Law Enforcement and Service Providers that are critical to the safe and responsible reentry of incarcerated offenders to our communities”.
Massachusetts has had a pilot reentry program in place since 1999 in Lowell, and has set up five Community Resource Centers where incarcerated offenders returning to the communities can receive assistance through the partnerships the Department of Correction has formed. These communities are Lowell, Springfield, Worcester, New Bedford and Boston. More information regarding Reentry or the grant information is available at: www.ojp.usdoj.gov.

I would like to take this opportunity to iform the rank and file what the stewards have been working on. We had a meeting with Mr. Coalter this week regarding the posting of all assigned jobs so that everyone would be able to bid on these positions. We seem to be at an impasse at this level so I scheduled a meeting with the commissioner to try and get some direction as to protect everyones rights as far as the transferred officers are concerned. The 5 and out has been on the front burner this week. This would open up positions down south and those offices wishing to go back closer to home would be able to do so at this time. The requirements to take advantage of this 5 and out are 20 years in or be age 55 and fully vested (10 years). The window of opportunity to take advantage of this was said to be 90 days. The scramble is on to pass this by 7-31. The general assembly is Tuesday 7-30 and I will be calling for a union meeting at this time to bring you up to speed on all the events any questions feel free to email me at co1fu@aol.com thank you Kenny Ferullo chief steward

Just got in from a wake, have a few wiskey's in me. Friend of mines daughter
died. Suicide or boyfriend murdered her, Az police are still looking into it.
One of them friday the 13th things.
Anyway Pizzi, you can't compare to me, and nobody that runs against me will
be able too. I'm not a politician by choice. I fought the good fight and this
is where I'm at. I bought a house in my home town of Norfolk which I was
lucky to be able to afford in this affluent town. It wasn't this way when I
was growing up. It was the hicks. Now the suburbs are the place the rich want
to live now.
Anyway, 3months after moving into my house in Norfolk I found out prison
sewerage was being illegally discharged into the lake I live on. Long story
short, I found out it was knowingly going on for 20 yrs that I can prove.
$25million later the prison has a state of the art septic system with
grinders at every prison and have to pump the sewerage up hill, back up
generators incase of power failure, the works...
The D.O.C. sewerage contaminated Norfolk's aquifier and I got all the
residents in the northern area of Norfolk free hook up to town water. (3-4k a
house not including betterment fee)
I'm still waiting for my cut of the law suit money.
The D.O.C. has by passed me for Sgt. about 27 times out of revenge. So I'll
cut managments balls off every chance I get. I fought hard until I started
fighting smart.
I got done about this time last year fighting my sewerage thing. My suit is
on hold, and we're waiting for a court date. So I got bored and decided to
focus on my home town of Norfolk who did NOTHING for me when I was fighting
the sewerage in my front yard for the previous 5 yrs. So I ran against the
Chairman of the board of Selectmen. He was a 2 term 6 yr incumbant. Graduate
of M.I.T., Masters from Harvard. But he wasn't a home town boy. I was. So I
stuffed my harley in the barn last spring, wore long sleeves to cover my
tattoo's and cut my hair. I put on the show and won the election. The town of
Norfolk LOVES me and all my inovative ideas. I'm no fool, the public is
fickle and I could be the scorn of the town next week. But you know somthing,
I DON'T GIVE A FUCK. I'm a smart biker that made good. I just left the bar
with a bunch of my buddy's and I'm the cat's ass among my friends and I've
made it to a postion in life that many never will. In the process I've gained
EXPERINCE that I can pass on to the UNION, and better myself at the same
time. If the ride stops here I'll be happy. If the membership decides to let
me go to the next level. My heart and soul is in it. I was born UNION, my
father was an Iron Worker Local 7 my whole life. I'm not so sure alot of the
membership knows exactly the sacrifices we as UNION members have to make
sometime, or are even willing to make those sacrifices. If they grew up the
way I did. They would have a few paychecks stashed away as personal UNION
dues so they could tell managment to suck their dick and who cares about a
few days pay!
Bla, bla, bla, bla
YOU FUCKING SCABS ARE DOING OUR WORK!!!!! In a real UNION a piece of steel
would fall on your head or your scab ass would fall in to a deep cement pour
and the rest of you assholes would take the hint and leave the job!
Unfortunatly we are Law Enforcement and we are above that.
Anyways, now I run a small town. I pass by laws routinely. I hang in
political circles socialy that we are hoping to influence politically. I want
to protect my UNION members from you scabs that are trying to infiltrate our
work place. I have the know how and the ability to pass legislation. I've
passed two peices at the state level already, I'm working on my third. I have
a track record. I get things done. If people get in my way I eliminate them.
The social workers are an easy but very real target. So I'm hammering them
right now for political reasons as well as the right reasons.
I also plan on taking the dream sheet sent in by all members each contract
negotiation period and seeing what laws I can pass from it and/or pass to run
interferance with our next contract.
I want to establish a coalition of communitiees that host correctional
institutions to build a voting base in the house and senate.
I want to work on Veterans benifits. Right now just to get non war time
veterans the buy back for retirment that war time vets now have. Embassy
bombings when I was in the service, peace time police actions and now the USS
Cole incident would support a bill extending benifits to non war time
veterans. We maintained a state of constant war time readiness when we were
active duty. We signed with the intent of sacrificing our lives for our
country if war broke out. Why did the Legislature have to draw a line between
veterans. I don't want that line. I'll fight to remove that line.
Well it's almost midnight I'm off to the Senate tommorrow for the day.
Mingling with all the right people and learning exactly what I'll need to
know when I assume the Legislative Postion for the UNION in March. The member
ship permitting. I've got the balls, the knowlege and the experince. Which is
what you need, in exactly that order. I need some sleep, good night brothers
sisters, managment and scabs.

I am truly upset with MCI's Neighborhood Plan Switch over. I don't even know how
to start. But here are the facts and the end results.
1) 2 phones lines in my home 615.---.---- & 615.---.----
2) Both lines were on one bill with Bell South
3) MCI called me on the phone refer to the Neighborhood Plan. I told
them I had 2 lines; they said one line $55 the second line for $20. I
agreed to the plan.
4) To make the switch Bell South knew to switch both lines over ( I verified this info with Bell South 7/19/2002) I only had one bill with both numbers.
5) MCI set up 2 separate accts. not joined.
6) MCI now says, I have to cancel my acct with MCI and go back to Bell South (which is crazy to start with) Let Bell south add the numbers together again, then drop BS and come back over to MCI.
7) According to BS, MCI has access to my phone records just like they do. MCI knows both numbers were on the same acct. When ever I talk to
BS or MCI I always ALWAYS state that I have 2 lines. BS states both lines were sent to MCI. So why did MCI set it up for 2 separate accts??
8) I get 2 full bills instead of 1 (not $20 on the 2nd line)
9) I did not want to go back and forth from BS to MCI then back to BS then MCI so I decided to cancel my second line with MCI (615.---.---- which I did not want to do) Hoping to add it later after this mess is
cleared up.
10) I found out that to add my second line back I will still have to set it up with Bell South, then switch it over to MCI (to go back with BS there is a $9.?? fee)
This is absolutely absurd. I think I like the Neighborhood Plan's idea; but they really screwed me by setting up 2 different accounts when they promised me the second line for $20. And sending me back to Bell South is absolutely ludicrous.

The general assembly had some decent information. First of all beginning in 2-02 all the money that we earn except for ROLL CALL and O.T. goes towards your retirement and not just your gross pay. The arbitration for the posting of the jobs is scheduled for 7-8-02 hopefully Mr. Coalter will be well enough to get through it this time. The arbitration concerning the 4 sgt's at concord transferring to central trans is completed and we should get a decision by the middle of next week. Baby bonds will be distributed in July the last day to get the babies social security number into the union is 7-5-02 if you have it give it to me and I will take care of it for you. The budget is still down 25 million dollars. Our only hope of averting layoffs is a supplemental budget when the governor signs the budget. I doubt that will happen. Our other option is early retirement. The 5 and out is drafted and will be heard when the senate reconvenes in September. If there are actual layoffs it will probably start around October. The e-board is trying everything in thier power to avert layoffs and some other things are happening but not being released not to promote false hope. The hardships of the transferred officers are being heard today along with the statewide transfer list. The e-board is optomistic that all the displaced officers will be back working closer to home within a year. It is still unclear whether or not the transferred officers will be incorporated into our job pick or allowed to keep thier shifts and days off for good. Thier is language that states both sides of the coin. The contract states administrative transfers get to keep thier shift and days off and the concord job pick language states that all officers working at mci concord will be subject to the job pick process. I will be working with the e-board and the commissioner to try and protect everyones rights. All officers who are in the military and were ordered to the olympics should have been paid, if you haven't been paid fax a copy of your orders to the e-board and hrd. The childrens scholarship applications have to be completed and sent in no later than 7-8-02 if anyone needs an application grab a steward they are in the union office.

You guys are lucky that you have a bitch board like this us CPO’s are not so lucky. Our board is censored by out E Board, Pizzi and Cutting, both real pieces of work. They use the board as their own propaganda machine and don’t allow others to speak their minds. Recently Cutting went on there and made derogatory remarks about some of the people and of course would not allow a response. We are in a very bad position right now, with Institutions closing, and forced transfers, plus there is talk of lay-offs. I notice a lot of bashing of your E Board, well so you know I think all of them are just as bad. We have a chapter President who is only provisional, and Cutting is a supervisor, so you can only imagine what it’s like. You’re lucky you have the freedom to express your displeasure. When the closings were first announced I suggested to our president that we should try to get together with MCOFU and try to fight the closings, big mistake. He’s more interested in bashing you guys than working for what’s best for the membership, which is too bad, I personally like the Officers I work with and think they do a fine job.

The latest information I have received regarding layoffs is this. We had 2 bills go in front of the senate last week both bills were denied. The next step comes when the budget actually hits the governors desk. There is always the possibility that our money may be slid in at that time. I doubt thats going to happen. The 5 and out is being drafted right now it states that any correctional staff with 20 years can get 5 years added to his time or his age. NO you cannot have 15 years and take the 5 and leave I wish that was an option but it isn't. Also if you are age 55 and are vested (have 10 or more years in) you will be able to retire at whatever percentage you have achieved. The e-board has asked for the commissioners layoff plan, he has yet to give it because he doesn't have one, it's never been done before. The reason the bill won't be passed before September is because congress convenes for the summer and doesn't reconvene until that time. There is also the possibility of a supplemental budget being passed in the fall. If you remember we received 14.7 million dollars last December to avert layoffs. If layoffs do become reality I don't believe it will happen until after the supplemental budget time. Also remember that there is alot of fat in the dept. There is over 140 provisional c.p.o.s. correctional staff make up 80% of the dept of correction there is a reason for that the prison won't run without security, not to take anything away from the c.p.o.s they feel they do the same job as we do, the only exception is they are not mcofu represented and they have all day shifts and weekends and holidays off. They are trying to be protected by the commissioner as he is beefing up the inmate population at Pondville and trying to justify moving more c.p.o's there. The bottom line is they don't have any civil service status being provisional so see you later. I will keep you informed every step of the way. We've all heard since the academy days to use your weingarten rights. what are they and when should I use them? I will try and put it into street terms how to use them. First of all what are they? The answer is your right to union representation. Does management have to tell me to get a steward? The answer is no you have to request it. What if management says no discipline is going to come out of this conversation should I still request a union rep? The answer is yes if discipline does result from a one on one conversation it becomes your word against theirs. If you have representation (witness) in essence they would have to be calling two people liars if the stories don't add up. If you are told that management has set up a meeting with you in advance it is good advice to put in writing a request to invoke your weingarten rights for this meeting. Remember that a paper trail is usually all the evidence introduced at hearings so it is to your benefit to have one of your own. Even if your going down to operations to request a day off it is good to have someone with you, it doesn't have to be a union rep at this point but any union member who can witness your name going into that book. The final bit of advice is this always, always invoke your weingarten rights, never leave a gray area for management to minipulate your words. The bottom line is expect every conversation with management could lead to discipline so know your rights. A PLACK OF LT CHARLES FARLEY ALONG WITH A NICE CEREMONY DEDICATING THIS TO CHARLIE IS A FIRST FOR CONCORD. MOST OF THE CREDIT FOR THIS ACHIEVEMENT GOES TO MR. COALTER.
